A writ petition has been filed with the High Court seeking annulment of the referendum held on February 12 and the results announced the following day.
The Chief Election Commissioner, the Cabinet Secretary and the Law Ministry Secretary have been made respondents.
Supreme Court lawyer ABM Ataul Majid Touhid submitted the writ on Tuesday, February 17, to the relevant branch of the High Court in the public interest.
He said the matter may come up for hearing next week before a bench led by Justice Fatema Najib.
According to the petition, the referendum process was marred by various irregularities and procedural violations. It argues that due to these alleged flaws, the results cannot be considered lawful or valid.
The petitioner has asked the court to declare the results void and order a fresh evaluation of the process. The writ also seeks a directive for the Election Commission to submit a detailed report and to reassess the results in light of the alleged irregularities.
Touhid said the petition was filed to safeguard public interest and uphold the right to a free and fair referendum. He added that if the process is compromised, the outcome cannot stand as legitimate.
